These Terms of Service ("Terms") govern your access to and use of bayoubeignet.com, our online store, products, subscriptions, content, and related services (collectively, the "Services"). The Services are operated by Bayou Beignet ("Bayou Beignet," "we," "us," or "our") and hosted by Shopify. By accessing the Services or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services.
1. Eligibility and permitted use
You must be able to enter a binding contract in your jurisdiction to make a purchase. If you use the Services for a business or another person, you represent that you have authority to bind that party. You may use the Services only for lawful, personal, household, or legitimate business purposes and in compliance with these Terms.
2. Product and food-safety information
We make reasonable efforts to present accurate product descriptions, images, ingredients, allergen information, weights, pricing, availability, preparation guidance, and expected yield. Packaging, ingredients, appearance, and results can change or vary. Images may show serving suggestions or preparation results. Always review the current physical package before preparing or consuming a product, especially if you have allergies, sensitivities, dietary restrictions, or medical concerns.
Our products are prepared and handled as described on the package. We do not represent that any product is free from allergens or suitable for a particular diet unless the current package expressly says so. Do not consume a product with a broken seal, damaged package, signs of tampering, or an expired date. Preparation content is general information, not medical, nutrition, or professional advice. You are responsible for safe preparation, hot-oil handling, storage, and serving.
3. Orders and acceptance
Your order is an offer to purchase. We may accept, decline, limit, or cancel an order for legitimate reasons, including product unavailability, pricing or description errors, suspected fraud, resale activity, shipping restrictions, or violation of these Terms. An order confirmation acknowledges receipt and does not guarantee acceptance. We may require additional verification before accepting or fulfilling an order.
4. Prices, payment, taxes, and promotions
Prices are shown in the currency displayed at checkout and may change without notice. Taxes, shipping, discounts, and other charges are calculated as shown at checkout. You represent that payment and order information you provide is accurate and that you are authorized to use the selected payment method. Promotions are subject to their stated terms, availability, and limits; they may not be combined unless expressly allowed.
5. Shipping and delivery
Shipping is governed by our Shipping Policy. Processing and transit times are estimates unless we expressly guarantee a date. You are responsible for providing a complete, accurate, and deliverable address and for promptly retrieving delivered food products. We are not responsible for delays or losses caused by an incorrect address, carrier disruption, severe weather, government action, or events outside our reasonable control, except to the extent applicable law provides otherwise.
6. No food returns; limited remedies
Because we sell food, all products are final sale and cannot be physically returned or exchanged for food-safety reasons, including unopened packages. Damaged, defective, unsafe, incorrect, unshipped, or legally protected orders are handled under our Return and Refund Policy. Nothing in these Terms limits a right that cannot lawfully be waived.
7. Cancellations and subscriptions
Order changes or cancellations are not guaranteed and are unavailable after processing or fulfillment. Recurring purchases are also governed by our Purchase Options Cancellation Policy and the terms displayed when you subscribe. You authorize recurring charges at the frequency and price disclosed at checkout until canceled.
8. Accounts
You are responsible for maintaining the confidentiality of account credentials and for activity under your account. Notify us promptly if you suspect unauthorized use. We may suspend or terminate access when reasonably necessary to protect the Services, customers, or our rights.
9. Prohibited conduct
You may not misuse the Services; violate law; infringe intellectual-property, privacy, or other rights; submit false or misleading information; introduce malware; scrape, crawl, copy, or reverse engineer the Services except as lawfully permitted; interfere with security or operation; impersonate another person; use the Services for fraud or abuse; or purchase products for unauthorized resale. Automated agents may access product information only through permitted channels and in compliance with applicable terms and technical controls.
10. Intellectual property
The Services and their content, including the Bayou Beignet name, logos, designs, photographs, graphics, text, recipes, packaging, and site presentation, are owned by or licensed to Bayou Beignet and protected by intellectual-property laws. No ownership right is transferred to you. You may not use our brand assets or content for commercial purposes without prior written permission.
11. Reviews, feedback, and submissions
If you submit a review, photograph, feedback, idea, or other content, you represent that you have the right to do so and that it is accurate and lawful. You grant us a worldwide, nonexclusive, royalty-free license to host, reproduce, display, adapt, and use that content for operating and promoting the Services, subject to applicable privacy law. We may moderate or remove submissions that violate law, platform rules, or these Terms.
12. Third-party services and links
The Services may use or link to Shopify, payment providers, carriers, review services, subscription services, analytics tools, social platforms, and other third parties. Their separate terms and policies may apply. We are not responsible for third-party content or services outside our control.
13. Privacy
Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge those practices.
14. Disclaimer of warranties
To the fullest extent permitted by law, the Services and content are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except that we do not disclaim warranties or consumer protections that cannot lawfully be excluded. We do not guarantee uninterrupted or error-free operation, that every display is accurate on every device, or that preparation results will be identical.
15. Limitation of liability
To the fullest extent permitted by law, Bayou Beignet and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, lost data, or loss of goodwill arising from the Services or products. To the fullest extent permitted by law, our aggregate liability for a claim relating to a purchase will not exceed the amount you paid for the product giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Bayou Beignet and its owners, employees, contractors, and affiliates from claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person's rights. This provision does not apply to ordinary consumer claims based solely on purchasing or using a product as intended.
17. Governing law and disputes
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law rules, except where the law of your residence provides non-waivable protections. Before filing a claim, please email contact@bayoubeignet.com and allow us a reasonable opportunity to resolve it. Subject to applicable consumer law and small-claims jurisdiction, disputes must be brought in the state or federal courts located in Orleans Parish, Louisiana, and the parties consent to those courts' jurisdiction.
18. Changes, severability, and waiver
We may update these Terms prospectively by posting a revised version and updating the date above. Changes do not retroactively alter an accepted order unless required by law or agreed by both parties. If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remainder will continue in effect. Failure to enforce a provision is not a waiver.
